7orbetter Affiliate Program — Terms & Conditions

These Terms & Conditions (the “Agreement”) govern participation in the 7orbetter Affiliate Program (the “Program”). By applying to or participating in the Program, you (“Affiliate,” “you”) agree to be bound by this Agreement with BBD Enterprises Inc. (“BBD,” “we,” “us,” or “our”), operator of 7orbetter.

If you do not agree, do not apply to or participate in the Program.

1) Enrollment & Acceptance

  • Application. Apply via https://7orbetter.com/affiliate_signup.php. You must be at least 18 years old and able to enter binding contracts.

  • Review. We review applications and may approve, reject, suspend, or terminate participation at our sole discretion.

  • Access. If approved, you’ll receive a unique affiliate ID and tracking link(s) (each, an “Affiliate Link”).

2) Affiliate Obligations

You agree to:

  • Comply with Law & Guidance. All applicable U.S. federal, state, and local laws and regulations, including FTC Endorsement Guides, CAN-SPAM, TCPA, and applicable privacy laws.

  • Truthful Marketing. No misleading, deceptive, or unsubstantiated claims about 7orbetter.

  • No Spam or Abuse. No unsolicited email/SMS, no cookie stuffing, forced clicks, adware/spyware, cloaking, device ID spoofing, fake leads, or incentivized signups that are not clearly disclosed and pre-approved by us in writing.

  • Search/Trademark Policy. Do not bid on, or use in ads, our trademarks or confusingly similar variations (e.g., “7orbetter,” “7 or better,” misspellings), including as keywords, ad copy, display URLs, or domain names, unless we expressly approve in writing.

  • Placement Restrictions. No promotion on properties containing unlawful, infringing, hateful, violent, or adult content that violates law; no content that violates any third party’s rights; no sites or channels that impersonate 7orbetter.

  • Disclosures. Where endorsements are made (web, social, email, video, etc.), you must provide clear and conspicuous FTC-compliant disclosures of your affiliate relationship.

  • Brand Use. Use only our approved logos/creatives and do not alter them without written permission.

  • No Self-Referrals or Employee Referrals. You may not refer yourself, your immediate household, or otherwise attempt to earn commission on your own activity.

  • Security. Keep Program credentials confidential; notify us immediately of suspected compromise.

Violation of these obligations may result in withheld commissions, account suspension or termination, reversal of prior payouts, and/or legal action.

3) Commission Structure

  • Options. Unless otherwise agreed in writing:

    • PPS (Pay-Per-Sale): $20 USD per qualified new paying member.

  • Qualification. A sale qualifies only if: (i) tracked to your Affiliate Link under our tracking systems, (ii) not canceled/refunded/charged back, (iii) is not fraudulent or a self-referral, and (iv) complies with this Agreement.

  • Payouts. Commissions are calculated monthly and paid by the 15th of the following month (approximate). Minimum payout: $20 USD. Balances under the threshold roll over.

  • Methods & Fees. PayPal, ACH, or wire transfer (you are responsible for any processor or bank fees).

  • Taxes. You are an independent contractor and responsible for all taxes. U.S. affiliates must provide a completed IRS Form W-9; non-U.S. affiliates must provide Form W-8BEN (or applicable W-8). We may withhold payment until required tax documentation is received.

We may audit, adjust, or reverse commissions for refunds, chargebacks, suspected fraud, or reporting errors.

4) Tracking & Attribution

  • Mechanism. Tracking generally uses cookies and/or IP/device signals.

  • Attribution Window. Standard cookie window is 30 days on a last-click basis unless otherwise specified in writing. Cross-device or cross-browser attribution is not guaranteed.

  • Tampering. Any attempt to manipulate or override tracking (e.g., cookie stuffing) is grounds for immediate termination and forfeiture of commissions.

5) Intellectual Property & License

  • We grant you a limited, revocable, non-exclusive, non-transferable license to display our approved names, logos, banners, and creatives solely to promote 7orbetter under this Agreement.

  • You shall not register or use any domain name, social handle, or app name that is identical or confusingly similar to our brand(s).

  • All goodwill arising from your use of our IP inures to BBD.

6) Confidentiality

You may receive non-public information about our business, performance, conversion data, or payouts. You agree to keep such information confidential, use it only for Program participation, and not disclose it to third parties except as required by law.

7) Term, Suspension & Termination

  • Term. Begins upon approval and continues until terminated.

  • Termination. Either party may terminate at any time, with or without cause, by written notice (including email). We may also suspend your account immediately for suspected fraud, non-compliance, or risk.

  • Post-Termination. You must cease using Affiliate Links and remove our IP/creatives. Earned but unpaid commissions will be paid following normal schedules subject to audit, refund/chargeback adjustments, and this Agreement. We may withhold final payment for up to 60 days to complete reviews.

8) Disclaimers; Limitation of Liability

  • The Program and all materials are provided “as is” and “as available” without warranties of any kind (express or implied).

  • We do not guarantee any level of traffic, conversions, or earnings.

  • To the maximum extent permitted by Florida law, our aggregate liability to you for claims arising from the Program shall not exceed the total commissions paid to you in the six (6) months preceding the event giving rise to the claim.

  • We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; or loss of data.

9) Indemnification

You agree to indemnify, defend, and hold harmless BBD, its affiliates, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your sites, ads, emails, social posts, or other promotional materials; (b) your breach of this Agreement; or (c) your violation of law or third-party rights.

10) Program Changes & Modifications

We may update, pause, or discontinue the Program; change commission rates, attribution rules, or policies; or modify these Terms at any time, in our discretion. We’ll provide notice by email and/or via the affiliate dashboard. Continued participation after the effective date of changes constitutes acceptance.

11) Data & Privacy

You must comply with all applicable privacy and marketing laws (including required consents and disclosures) and with our Privacy Policy. You will not pass us personal data you are not authorized to share. You will honor user privacy choices and applicable do-not-contact rules.

12) Independent Contractor

You are an independent contractor; nothing here creates a partnership, joint venture, employment, or agency relationship.

13) Governing Law & Venue

This Agreement is governed by the laws of the State of Florida, without regard to conflict of law principles. The parties consent to exclusive jurisdiction and venue in the state and federal courts located in Miami-Dade County, Florida.

14) Miscellaneous

  • Assignment. You may not assign or transfer this Agreement without our prior written consent. We may assign to a successor or affiliate.

  • Severability. If any provision is found unenforceable, the remainder remains in effect.

  • No Waiver. Failure to enforce a provision is not a waiver.

  • Force Majeure. We are not liable for delays/failures caused by events beyond our reasonable control.

  • Notices. We may send notices to your account email; you may send notices to affiliates@7orbetter.com.

  • Entire Agreement. This Agreement constitutes the entire agreement between you and BBD regarding the Program and supersedes all prior or contemporaneous agreements.

c) Payment/Payout Information (Affiliates)

  • We collect and process tax forms as required by law.

  • Payout details are processed by us and/or trusted payment processors.

We do not collect information from individuals under 18. Do not use the Services if you are under 18.

3) How We Use Information

  • Operate, maintain, and improve the Site and Affiliate Program.

  • Process affiliate applications, track referrals, attribute commissions, and make payouts.

  • Communicate important updates (e.g., account changes, payout notices, policy updates).

  • Detect, investigate, and prevent fraud, abuse, or security incidents.

  • Comply with legal, tax, and regulatory obligations.

  • Service Providers: We share data with vendors who help with hosting, analytics, email delivery, payout processing, tax form collection, and security.

  • Business Transfers: Your information may be transferred in connection with a merger, acquisition, or asset sale.

5) Affiliate Tracking & Cookies

We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure.

8) Your Rights & Choices

General (all users):

  • Access/Correction: Request a copy of your data or ask us to correct inaccuracies.

  • Deletion: Request deletion (subject to legal/operational retention needs).

  • Opt-Out: Opt out of non-essential emails/marketing (we’ll still send essential notices).

California (CCPA/CPRA):

  • Right to know/access, correct, and delete personal information.

  • Right to opt out of sale or sharing for cross-context behavioral advertising (we do not sell your personal information).

  • Right to non-discrimination for exercising your privacy rights.
     If our practices change to include “sale” or “sharing,” we will update this Policy and provide required opt-out mechanisms.
